Buying condos in Phuket: about co-ownership title

Condos in Phuket have their own type of title, which gives certain rights to the various owners of the condominium. These rights will be in respect of part of a building or buildings, a small share in the plot, other common property (such as a swimming pool) and the common parts of the building (such as the stairwell or lobby).
Similarly to condominium schemes in many other countries, common areas of condos in Phuket are jointly owned, while accommodation units are individually owned. The title must specify the ground surface of the private apartment, the surface area of the common ground and the percentage of common ownership that the apartment represents. This percentage also represents the right to vote in the condo or homeowners association.

Condos in Thailand and transfers of building ownership

In condos in Phuket, each accommodation unit has an official title document, and a condo unit’s sale or long-term lease must be registered at the District Land Office.
The transfer of a building, in contrast to its land, requires the publication for 30 days in a public notice, to give the opportunity to challenge the origin of possession.

Chanote (Nor Sor 4), or freehold title deed

Officially called Nor Sor 4 Jor or more commonly Chanote, this is a freehold title deed. As a certificate of ownership of the land, it can be used as evidence to government authorities who require confirmation of your rights. It is issued by the Provincial Land Office in Phuket, which is the provincial office in charge of the
land registry, using GPS to track and identify with precision the boundaries of the plot. This is the most secure type of land title, but land for sale in Phuket with a Chanote can often be difficult to find.

Sor Kor 1

Sor Kor 1 is a form of notification of land ownership, dating from 1954, which demonstrates and ensures rights to occupy and use the land. It offers few real rights and so, as indicated above, foreigners who wish to purchase land for sale in Phuket should only consider a plot to which a Chanote (Nor Sor 4), a Nor Sor 3 or a Nor Sor 3 Gor applies.
